MATADOR TRIPS TERMS AND CONDITIONS



Definitions

Agreement” means this Terms and Conditions and all other terms, conditions and policies incorporated by reference herein.


Matador” means Matador Ventures, Inc. and its parents, affiliates, subsidiaries, licensees, legal representatives, contractors and others acting under Company’s permission, successors and assigns.


Matador Trips” means the program titled Matador Trips as administered by Matador and the website pages located at: https://matadornetwork.com/trips/

Passenger” and “You” means the individual person traveling on a Trip (or the legal guardian of a traveler under the age of 18). Each and every individual attending a Trip must individually register with Matador.


Transportation Service Provider” means the local operator and/or transporter who will perform the Trip services.


Trip” means any travel arrangement or package offered by Matador Trips.


  1. Matador Site and Services Terms, Conditions, and Privacy

Matador Trips is part of the Matador Network website and online services (“Services”) and the Terms and Conditions and Privacy Policy apply.


  1. Payment and Purchase

    1. Fees. The fees payable in connection with your purchase of any Trip ("Fees") will be specified via the Services. All Fees are denominated in U.S. dollars (except as otherwise indicated).

    2. Payment in Full. Payment in full is required upon purchase. Your spot will not be reserved until we receive payment in full. You will be issued a receipt for your purchase within five (5) business days.

    3. Payment Method. You may only pay Fees using valid payment methods acceptable to us, as specified via the Services. You represent and warrant that you are authorized to use the payment method you designate via the Services. You authorize us to charge your designated payment method for the total amount of your purchase, including any applicable taxes and other charges. If the payment method cannot be verified, is invalid, or is otherwise not acceptable to us, your purchase may be suspended or cancelled.

    4. Taxes. You are responsible for any sales, duty or other governmental taxes or fees due with respect to your purchase of a Trip.

    5. Discounts and Promo Codes. Promo codes and discounts cannot be applied to previously completed purchases. To apply a promo code, you must enter it prior to completing your purchase. Discounts and promo codes are non-transferable and not redeemable for cash. Limit one promo code or discount per purchase.


  1. Cancellation

    1. Upon cancellation by Passenger:

      1. Upon cancellation by Passenger: No refunds are available for any Passenger cancellations less than thirty (30) days before the departure date. If Passenger cancels more than 30 days before the departure date, Matador will refund 50% of the purchase price. No refunds will be made for Passengers who do not arrive in time for departure, regardless of reason, although reasonable attempts will be made to contact you prior to departure. Passengers are encouraged to obtain travel insurance to help with unforeseen circumstances and cancellations. Matador does not provide travel insurance.

    2. Upon Cancellation by the Transportation Service Provider:

      1. (For California Residents): Where the Passenger is not at fault and has not canceled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the Passenger, all sums paid to Matador for services not provided will be promptly paid to the Passenger, unless the Passenger advises Matador in writing, after cancellation. This provision does not apply where Matador has remitted the payment to another registered wholesale seller of travel or a carrier, without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon transportation or service. In this situation, Matador must provide the Passenger with a written statement accompanied by bank records establishing the disbursement of the payment, and if disbursed to a wholesale seller of travel, proof of current registration of that wholesaler. Whenever possible, the Trip will be rescheduled for the next available departure date. If you authorize us to do so, we will transfer your Trip to the next available departure date and no refund will then be made.

      2. (For All Other Passengers): Where the Passenger is not at fault and has not canceled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the Passenger, the Trip will be rescheduled for the next available departure date. If you are unable to attend the next available departure date, no refund will be made. If the Trip is unable to be rescheduled by the Transportation Service Provider, Matador will provide a full refund.


  1. Warranties and Representations

    1. Matador represents and warrants that it has the right to enter into any and all agreements associated with Matador Trips, that no services offered or provided by Matador infringes any third parties, and all laws, statutes and regulations are followed. Matador also represents and warrants that it is a registered Seller of Travel in the State of California, registration #____________ (California does not endorse any seller of travel).

    2. Passenger represents and warrants that they have the right to enter into this Agreement and Passenger acknowledges, accepts and agrees with these Terms and Conditions. Passenger further represents and warrants that they have reviewed the Matador Trips website and accompanying information, including this document, prior to purchase.


  1. Indemnity

You hereby expressly release Matador from any and all liability, controversies, claims, suits, injuries, loss, harm or damages arising from or related to disputes, dealings, or interactions between you and any other users, Transportation Service Providers, other Passengers or other third parties. You expressly waive any rights you may have under California Civil Code § 1542 as well as any other similar statute or common law principles that would otherwise limit the coverage of this release to include only those claims which you may know or suspect to exist in your favor at the time of agreeing to this section 5. You further hereby agree not to assert any claim of any nature whatsoever against Matador relating to the exercise of these Terms and Conditions.


  1. Release of Liability

You understand that travel with Matador Trips may be hazardous and involve the risk of injury, sickness and possibly death, as well as damage to property, when traveling to and from and/or within these international destinations. You understand that you may need to travel and live in very primitive areas, risk violence from crime, war, terrorism, political unrest and other dangers, and may be exposed to food and water-borne diseases and to disease from other carriers or while traveling internationally. You understand that some diseases may not produce symptoms during the actual trip but may occur after the trip. You understand also that medical facilities abroad may not be of the quality of medical facilities in the United States.


You understand that while Matador and the Transportation Service Providers may take reasonable steps to ensure your safety during travel and while participating in sponsored activities during the Trip, that these precautions are merely made in good faith and do not warrant acceptance of liability. You voluntarily and personally assume the risk of any and all consequences of your travel with Matador Trips and the Transportation Service Providers. You expressly waive your right and the right of any of your heirs, legal representatives and assigns to sue or otherwise collect damages of any kind from Matador Network, its officers, personnel or volunteers resulting from any cause whatsoever including but not limited to sickness, personal injury, property damage, delay, and change of schedule, wrongful death, theft or loss of property.


  1. Appearance, Publicity and Image Rights

You authorize Matador to video record and photograph your image, your voice, conversation and sounds, including any performance of any musical composition(s). Matador shall be the exclusive owner of the results and proceeds of such photography and recording with the right, throughout the world, in perpetuity, to copyright, to use and to license others to use, in any manner, all or any portion of the photography or recording in connection with the Matador Trip or otherwise, including third party licensees of Matador and in connection with the promotion, advertising, sale, publicizing or exploitation of Matador or otherwise, ancillary products and Matador’s affiliated services. Matador shall have the right to modify the recordings and photography in its sole discretion. You acknowledge that Matador will rely on this permission potentially at substantial cost and agree not to assert any claim of any nature whatsoever against anyone relating to the exercise of the permissions granted hereunder.


  1. Choice of Law

This Agreement shall be construed and enforced in accordance with the laws of the United States and the State of California, and the courts of the United States shall have jurisdiction.


  1. Dispute Resolution

If there is any dispute as between the parties concerning any term or provision of this Agreement then the parties shall attempt to settle such dispute first by way of negotiation. If the dispute is not settled by negotiation then the parties shall submit to binding arbitration in accordance with JAMS.


  1. Severability

In the event that any one or more of the provisions contained herein shall, for any reason, be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provisions of this Agreement, but this Agreement shall be construed as if such invalid, illegal or unenforceable provisions had never been contained herein, unless the deletion of such provision or provisions would result in such a material change so as to cause completion of the transactions contemplated herein to be unreasonable.


  1. Change of Terms

Matador Trips Terms and Conditions are subject to change at any time without notice. Each transaction will be subject to the specific Terms and Conditions that were in place at the time of transaction.


  1. California Resident Disclosures

(For travelers purchasing from within California): Transactions are covered by the California Travel Consumer Restitution Fund (TCRF) if the passenger is located in California at the time of payment. Eligible passengers may file a claim with TCRF if the passenger is owed a refund of more than $50 for transportation or travel services which the seller of travel failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRF within 12 months after the scheduled completion date of the travel. A claim must include sufficient documentation to prove your claim and a $35 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a TCRF claim. You may request a claim form by writing to: Travel Consumer Restitution Corporation; P.O. Box 6001; Larkspur, CA 94977-6001 or by visiting TCRC’s website at: www.tcrcinfo.org.


(For travelers purchasing from outside of California): Transactions are not covered by the California Travel Consumer Restitution Fund.


California law requires certain sellers of travel to have a trust account or bond. This business has a bond issued by Great American Insurance Company in the amount of $20,000.
